Access to and use of the Website and the products/services available through it (the “Services”) are subject to these Terms & Conditions (“Terms”). We may update these Terms from time to time; please check this page for changes. Access is provided on a temporary “as-is” basis; we may withdraw or amend Services without notice. We will not be liable if the Website is unavailable at any time. We may restrict access to parts or all of the Website from time to time.

This Website may contain links to other websites (“Linked Sites”) not operated by us. We have no control over Linked Sites and accept no responsibility for them or for any loss or damage arising from your use of them; your use is subject to each site’s terms.

1) Scope & Jurisdiction

• India-only: Sales, fulfilment, shipping, and customer support are limited to India.

• Governing law / courts: Indian law applies. The courts at Bengaluru, Karnataka have exclusive jurisdiction.

2) Website Access, Third-Party Tools & Cookies

We may change, suspend, or withdraw the Website/Services without notice. Embedded tools (e.g., courier tracking, payment gateway pages, calculators) are provided “as-is” and governed by third-party terms.
We may use analytics and, with your consent, advertising technologies (e.g., cookies/pixels). See our Privacy Policy and cookie settings for details and controls.

3) Eligibility, Accounts & Acceptable Use

You must be 18+ to contract on the Website and use a valid payment method. You’re responsible for your account credentials and for providing accurate information. Do not misuse the Website (malware, hacking, scraping, spam, IP infringement, illegal/obscene content, attempts to impair performance). We may suspend or terminate access/accounts for abuse, fraud, or policy violations.

4) Intellectual Property, Software & Content

All software and content (including images) on the Website is owned by us or our licensors and protected by law. You may store/print/display content for personal use only. You may not publish, manipulate, distribute, reproduce, or use content for any commercial purpose without written consent. Third-party trademarks belong to their owners.

User Reviews & Feedback (licence)

By submitting reviews, photos, or feedback, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content on our Website and marketing, and you confirm you have the right to grant this licence. We may moderate or remove content that violates these Terms or applicable law.

5) Terms of Sale

(a) Our Contract. Your order is an offer to buy. We accept only when we send a dispatch-confirmation email. Only items listed in that email form part of the contract. We may act as agent for some third-party products; where a contract is made with a third party, their terms apply.
(b) Pricing & Availability. We strive for accuracy, but errors may occur. If we discover an error, we may correct it, seek your reconfirmation at the corrected price, or cancel and refund. If we cannot contact you, we will treat the order as cancelled and refund. Delivery charges (if any) are displayed at checkout.
(c) Payment & Authorisation. We perform a standard authorisation to verify funds. Your payment method may be authorised/held at order time and captured per gateway flow. Funds received upon capture are applied as consideration for the goods listed in the dispatch-confirmation.
(d) GST Window. Any GST input/output concerns must be raised within 90 days of the invoice date.
(e) Our Right to Cancel (pre-dispatch). We may cancel any order prior to dispatch (full refund) for reasons including pricing/description errors, stock unavailability, address/verification issues, or suspected fraud.
(f) Availability / Unable to Fulfil. If we are unable to fulfil, we will cancel and refund in full. We may limit quantities per order/customer.
(g) Payment Security & Modes. Payments are processed via secure gateways. Any platform/gateway charges are shown at checkout. Orders are prepaid only; Cash on Delivery (COD) is not available.
(h) Title & Risk. Title passes on full payment and dispatch; risk of loss passes on delivery.
(i) Pre-builts & Custom Builds. Not cancellable or returnable except for DOA/physical transit damage reported per our Returns Policy. If any component is EOL/unavailable during build, we may propose an equivalent or better alternative for your approval.
(j) Customer Cancellations. You may cancel before dispatch with a 3% deduction (gateway/platform fees). After dispatch: cancellation is not possible. Refusing/not collecting a non-damaged delivery is not a return or cancellation and no refund will be issued.
(k) Processing & Dispatch. Typical processing/dispatch time is 1–3 business days (Mon–Sat; public holidays excluded).
(l) Service Messages. You agree we may send transactional communications (order confirmations, shipping updates, support messages) via email/SMS/WhatsApp as part of order fulfilment and support.

Compatibility

Product compatibility (e.g., component fit/BIOS/support) depends on your system; please verify before purchase. We’re happy to guide pre-sale, but we cannot guarantee compatibility in all builds.

6) Prohibitions & Security

You must not commit or encourage criminal offences; transmit viruses/trojans/worms/logic bombs; hack; corrupt data; cause annoyance; infringe proprietary rights; send unsolicited advertising (“spam”); or attempt to affect performance/functionality of facilities accessed through the Website. Breaches may be reported to authorities. We are not liable for damage caused by denial-of-service attacks, malware, or other harmful material that may infect your devices/data due to your use of the Website or downloads from it or Linked Sites.

7) Shipping, Returns/Refunds & Warranty (Incorporated)

Our Shipping & Delivery Policy, Returns, Refunds & Cancellations Policy, and Privacy Policy are incorporated by reference and apply to all orders.

Warranty (summary). Warranty is as per the manufacturer/authorized service centres from invoice date. We can assist with RMA case creation; to-and-fro shipping to service centres is per brand policy and typically customer-borne unless on-site service applies. Warranty excludes physical/liquid damage, tampering, improper installation, power issues, and software corruption.
Evidence for DOA/Damage. Please follow our Returns Policy instructions (including continuous unboxing video/photos) to process DOA/physical damage claims.

Warranty claims are processed as per the manufacturer/ASC policy. To-and-fro shipping to service centres follows brand rules and is typically customer-borne unless on-site service applies.

8) Force Majeure

We are not liable for delays or failures arising from events beyond reasonable control (e.g., acts of God, epidemics, strikes, governmental actions, courier/network/provider outages, extreme weather).

9) Limitation of Liability

The Website and materials are provided without warranties of any kind. To the fullest extent permitted by law, we exclude liability for any damages, including direct, indirect, special, consequential, punitive, or incidental damages (e.g., loss of use, profits, data, goodwill) arising out of or related to use, inability to use, performance, or failures of the Website/Linked Sites/materials, whether in contract, tort, equity, statute, or otherwise. Nothing excludes liability for death/personal injury due to negligence, fraud, or other non-excludable liabilities.

10) Indemnity

You agree to indemnify, defend and hold harmless www.golchhait.com, its directors, officers, employees, consultants, agents, and affiliates from any third-party claims, liability, damages, and costs (including legal fees) arising from your use of the Website or your breach of these Terms.

11) Assignment & Termination

We may assign our rights and obligations under these Terms; you may not assign yours without our prior consent. We may suspend or terminate access/accounts for breach, fraud, or abuse; obligations accrued prior to termination (including payment obligations) survive termination.

12) Linking, Trademarks & Third-Party Copyright

You may link to our home page fairly and legally, without damage to our reputation or implying association/approval/endorsement. Do not frame the Website or link from a site you do not own. We may withdraw linking permission without notice.
Except where stated otherwise, persons (names/images) and third-party trademarks/content/services/locations on this Website are not associated with or endorsed by us. Trademarks/names are owned by their respective owners and used only to identify products/services.

13) Variation, Invalidity, Waiver, Entire Agreement

We may amend, remove, or vary Services/pages at any time without notice. If any part of these Terms is unenforceable, the remainder remains in full force; clauses shall be interpreted to preserve validity where possible. If you breach these Terms and we take no action, we do not waive our rights in other situations. These Terms constitute the entire agreement between you and www.golchhait.com and supersede prior agreements; any waiver is effective only if in writing and signed by a Director of www.golchhait.com.
